Terms of Service

1. About ROR

ROR (“the App”, “we”, “us”, “our”) is a gamified running platform operated by Mobinsons Ventures Private Limited, registered in India. The App lets you track runs via GPS, claim real-world territories (“Realms”), capture hex zones, join squads, compete on leaderboards, earn XP and badges, and participate in community features. By creating an account or using any part of the service you agree to these Terms.

2. Account Registration

• You must be at least 18 years of age to create an account, in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) §9 which classifies all persons under 18 as children requiring verifiable parental consent.
• You must provide accurate information during registration (name, email, phone number).
• You are responsible for maintaining the security of your account credentials.
• One account per person. Creating multiple accounts to gain unfair advantages is prohibited.
• We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable Use

Detailed rules for posts, chat, realm names, squad names, usernames, and bios are in our Community Guidelines, which form part of this agreement. In summary, you agree not to:

• GPS spoofing or location manipulation — Using mock locations, VPNs, emulators, or any tool to falsify your GPS position is strictly prohibited and will result in permanent account termination.
• Cheating or exploiting — Using bots, scripts, automated tools, or any means to artificially inflate runs, XP, zone captures, or leaderboard rankings.
• Harassment or abuse — Bullying, threatening, or harassing other users through squad chat, realm names, posts, or any other feature.
• Offensive content — Posting realm names, squad names, bios, or any content that is obscene, hateful, discriminatory, or violates applicable law.
• Impersonation — Pretending to be another person or entity.
• Reverse engineering — Attempting to decompile, disassemble, or reverse-engineer the App or its servers.
• Scraping or data harvesting — Collecting data from the App or its APIs without authorization.

4. Subscriptions & Payments

• ROR offers a free tier and a premium subscription (“ROR Premium”).
• Premium subscriptions are billed via Razorpay (India) or Stripe (international).
• Subscriptions auto-renew unless cancelled before the renewal date.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• Prices are listed in INR and may be updated with 30 days' prior notice.
• Free trials convert to paid subscriptions automatically unless cancelled before the trial ends.
• Refunds are governed by our Refund & Cancellation Policy.

5. User Content

• You retain ownership of all content you create (realm names, squad names, posts, photos, bios).
• By posting content you grant us a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute your content solely for operating and promoting the service.
• You are solely responsible for content you post. We may remove content that violates these terms or our Community Guidelines.
• If you believe content on ROR infringes your copyright, see our Copyright & Takedown Policy.
• Run data (GPS tracks, distance, pace, duration) is stored to provide the service and may be used in aggregated, anonymised form.

6. Data Collection & Storage

• We collect only the data necessary to operate the service: email, phone, GPS location during runs, device information, and usage analytics.
• All personal data is stored on encrypted servers in Singapore (AWS ap-southeast-1), co-located for low India latency; cross-border transfers are made in accordance with the DPDPA, 2023.
• We do not sell, rent, or share your personal data with third parties for marketing or advertising purposes.
• Data is shared only with payment providers (Razorpay/Stripe) for processing transactions, and with infrastructure providers strictly for hosting.
• You may request deletion of your data at any time — see our Privacy Policy for details.
• Communications & consent: we send service and transactional messages as part of operating ROR. We send marketing messages (including on WhatsApp and SMS) only if you give separate, explicit opt-in consent — joining the waitlist or accepting these Terms does not opt you in. You can withdraw consent anytime by replying STOP, using an email unsubscribe link, or emailing [email protected]. See our Privacy Policy §3.

7. Realm Requests & Premium Features

• Creating a Realm is a premium feature requiring admin approval.
• Realm requests must comply with our validation rules: no open roads, min/max area limits, accurate boundary data.
• We reserve the right to reject, modify, or remove Realms at our discretion.

8. Termination

We may suspend or terminate your account at any time for violations of these terms. Upon termination you lose access to all account data, realms, zones, XP, badges, and squad memberships. You may request deletion of your account and personal data at any time.

9. Disclaimers

• ROR is provided “as is” and “as available” without warranties of any kind.
• We do not guarantee uninterrupted or error-free service.
• Running is a physical activity. You are responsible for your own safety. Please read our Runner Safety guidelines. Do not run in unsafe areas or dangerous conditions while using the App.
• Realms and zones are virtual boundaries on a map. Never cross real-world hazards (private property, traffic, water bodies, restricted areas) to capture a virtual zone.
• We are not liable for injuries, accidents, or damage arising from your use of the App.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, ROR shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Governing Law & Dispute Resolution

These terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, and the Companies Act, 2013. Disputes shall be subject to the exclusive jurisdiction of the courts at Kendujhar, Odisha, India (registered office district), with appellate jurisdiction at the High Court of Orissa, Cuttack.
